BB Ertaş Turizm Ltd. Şti. operates the Group A travel agency registered as Tree of Life Travel under licence number 14806. The Travel's Cappadocia brand is used by this company.
This agreement is drawn up under Law No. 6502 on the Protection of Consumers and the Distance Contracts Regulation. It covers bookings made through the website and messaging channels for tours, balloon flights, transfers and multi-day packages that include accommodation. It is formed when we confirm your booking request.
1. Parties
Seller: BB Ertaş Turizm Ltd. Şti.. Its trade name, address, tax and registry details, travel agency licence details and contact channels are written on the contact page, in the footer of the site and on the booking voucher.
Buyer: the person whose name and contact details appear in the booking request. The buyer confirms that, when booking for others who will take part, they have told those people about this agreement.
2. Subject matter
The agreement concerns the organisation and delivery by the seller of the tour, balloon flight, transfer or multi-day package with accommodation that the buyer has chosen. The name, length, programme, group limit, guide language, meeting and pick-up details, and the items included in and excluded from the price are set out on the tour page. Before booking the buyer confirms having read this information and having been told about the main features of the service, the total price, the way of payment and performance, and the cancellation terms.
Balloon flights are operated by licensed balloon operators; for these flights the seller handles the booking and organisation. Whether a flight goes ahead is decided by the operator according to weather and visibility.
3. Price and payment
- Prices are given in euros (€) and, unless stated otherwise, per adult. Child and infant prices are shown on the tour page, and the price of a multi-day package is per person in a double room.
- No payment is taken when a booking is requested or on the website. The price is paid on the day the service is provided, in cash (EUR, USD, TRY) or by card; on multi-day packages the cost of accommodation and tours is paid on arrival.
- When paying in a currency other than euros, the rate on the day of payment applies, and the amount is told to you before you pay.
- Items with no obligation to buy, such as workshop or village-house products, and meals, drinks and tips that are not included are the buyer's own cost.
4. Delivery of the service
The seller picks guests up from hotels in the free pick-up area and sends the pick-up time by WhatsApp the evening before, after the booking. The buyer is ready at the place and time given; if the pick-up is missed the service may be delivered only in part or not at all, and a balloon launch in particular waits for nobody. For reasons such as safety, weather, road conditions or a closed site the seller may change the order of the programme and its stops, in a way that keeps the nature and value of the service.
The buyer must give accurate information on age, health and safety and follow the safety instructions of the guide and pilot. Children under six cannot board a balloon, and the balloon is not recommended for pregnant guests or anyone with a serious back or neck problem. Alcohol tastings are for guests aged 18 and over only.
5. Withdrawal and cancellation
Under the Distance Contracts Regulation there is no right of withdrawal for contracts on accommodation, transport, food and drink, and leisure activities that must be carried out on a specific date or period. Even so, the seller gives the buyer a contractual right to cancel: cancellation is free up to 24 hours before the tour time. For multi-day packages this period is 24 hours for the day-tour parts and 7 days before arrival for the accommodation, after which a partial charge applies to the accommodation. If you do not show up without notice, the price is not refunded. If a balloon flight is cancelled because of weather or flight conditions, the buyer chooses between a transfer to the next morning at no charge and a full refund. Details are in the cancellation and refund policy.
6. Force majeure and weather
Events beyond the control of the parties count as force majeure, such as natural disasters, epidemics, official bans or restrictions, road closures, extreme weather and flight cancellations. In such cases performance may be postponed, or for the part that cannot be performed a date change at no charge or a refund is offered. Neither party is held liable for a delay or failure caused by force majeure.
7. Responsibilities of the parties
The seller performs the service with care and in the form advertised, and tours run under the compulsory travel agency and passenger liability insurance. For services supplied by third parties, such as the balloon operator or the accommodation, the seller is responsible to the extent required by the relevant law. The buyer is responsible for loss arising from their own fault or from ignoring warnings, and for looking after their belongings. On multi-day packages the applicable provisions of package travel law also apply.
8. Personal data
The buyer's personal data is processed for the purposes and on the terms described in the privacy policy and KVKK information notice.
9. Dispute resolution
For disputes arising from this agreement, within the monetary limits announced each year, the consumer arbitration committee where the buyer lives or where the transaction took place has jurisdiction, and consumer courts for amounts above the limit.
10. Entry into force
The agreement comes into force when the seller confirms the buyer's booking request. Booking records and correspondence are kept electronically, and on request the buyer can obtain a copy of the agreement and the booking voucher.
